{"id":266,"date":"2020-07-27T09:14:42","date_gmt":"2020-07-27T09:14:42","guid":{"rendered":"http:\/\/alhaydari.com\/en\/?p=266"},"modified":"2020-07-27T09:14:44","modified_gmt":"2020-07-27T09:14:44","slug":"as-you-know-the-fatwa-of-the-most-of-the-jurists-is-that-if-a-father-intentionally-kills-his-child","status":"publish","type":"post","link":"https:\/\/alhaydari.com\/en\/2020\/07\/27\/as-you-know-the-fatwa-of-the-most-of-the-jurists-is-that-if-a-father-intentionally-kills-his-child\/","title":{"rendered":"As you know the Fatw\u0101 of the most of the jurists is that if a father intentionally kills his child"},"content":{"rendered":"\n<p>Wa \u02bfalykum al-Sal\u0101m<\/p>\n\n\n\n<p>Ayatollah Haydari&#8217;s Fatw\u0101 is that, as a first and foremost ruling, anyone who intentionally kills a human being their sentence is execution and Qi\u1e63\u0101\u1e63 (legal retribution) and it does not matter whether the killer has a parent-child relationship with the victim or not.<\/p>\n\n\n\n<p>According to Ayatollah Haydari&#8217;s basis in the U\u1e63\u016bl al-Fiqh (principles of jurisprudence), it is not permissible to specificize al-\u02bfumum\u0101t al-Qur\u02beniyah (the Qur&#8217;anic generalities) by al-Akhb\u0101r al-A\u1e25\u0101d (the single quoted narrations that are not Mutaw\u0101tir) unless there are definite clues for that narration.<\/p>\n\n\n\n<p>It is necessary to mention that most of the contemporary Shi\u02bfa jurists believe that to specificize al-\u02bfumum\u0101t al-Qur\u02beniyah by al-Akhb\u0101r al-A\u1e25\u0101d is permissible, however, early Shi\u02bfa jurists, including Sayyid Murta\u1e0da, Shaykh \u1e6c\u016bsi and Mu\u1e25aqiq al-\u1e24elli, did not consider it permissible.<\/p>\n\n\n\n<p>Based on this, the general verses such as:<\/p>\n\n\n\n<p>&#8220;\u0648\u06a9\u062a\u0628\u0646\u0627 \u0639\u0644\u06cc\u0647\u0645 \u0641\u06cc\u0647\u0627 \u0627\u0646 \u0627\u0644\u0646\u0641\u0633 \u0628\u0627\u0644\u0646\u0641\u0633 (\u0645\u0627\u0626\u062f\u0629 45)&#8221;<\/p>\n\n\n\n<p>And We ordained for them therein a life for a life<\/p>\n\n\n\n<p>And:<\/p>\n\n\n\n<p>&#8220;\u0648\u0644\u06a9\u0645 \u0641\u06cc \u0627\u0644\u0642\u0635\u0627\u0635 \u062d\u06cc\u0627\u0629 \u06cc\u0627 \u0627\u0648\u0644\u06cc \u0627\u0644\u0627\u0644\u0628\u0627\u0628 \u0644\u0639\u0644\u06a9\u0645 \u062a\u062a\u0642\u0648\u0646 &nbsp;(\u0628\u0642\u0631\u0629 179)&#8221;<\/p>\n\n\n\n<p>And there is for you in Qi\u1e63\u0101\u1e63 (legal retribution) [saving of] life, O you [people] of understanding, that you may become righteous.<\/p>\n\n\n\n<p>will remain general and those contradicting narrations will be rejected.<\/p>\n\n\n\n<p>It must be added that from the point of view of Ayatollah Haydari, while the initial sentence for the murder of a child by the father is Qi\u1e63\u0101\u1e63 (legal retribution), nevertheless, according to the law of each country and by competent legal institutions, each murder case must be investigated uniquely and separately to determine whether the killer in a premeditated murder had an acceptable and rational justification or not. In most cases, premeditated murders have no reasonable justification and the killer- even if he is the father- should be sentenced to retribution and execution unless in very rare cases where due to acceptable and reasonable justifications, the killer should not be sentenced to death.<\/p>\n\n\n\n<p>In other words, according to Ayatollah Haydari&#8217;s method of Ijtihad and jurisprudence, prior to the issuance of any order, its al-I\u1e6dl\u0101q al-Afradi and al-Zam\u0101ni must be reviewed and proven, that is, it must be seen whether such a verdict is the same or different, in all cases and about all people and all times and different circumstances or not.
